Hello. I'm a law student, nearing my bar review and I'd like to practice my knowledge by answering legal questions so kung sino dito may questions regarding labor (which is one of my favorite law subjects) you can post them [which can be but is not limited to union issues, employer-employee relations, hours of work, work compensation issues] and I'll do my best to share my knowledge and answer them based on the applicable laws

Hello. Ano ba living allowance na tinutukoy mo? Is it the Cost of Living Allowance (COLA) or yung Living Away From Home Allowance (LAFHA)?

For Cost of Living Allowance (COLA), kapag minimum wage earner ka, you are exempt from tax deduction. This means if you're receiving P466.00 a day, you're exempt from tax deduction. Pero kapag above minimum wage earner ka, the COLA will be part of the compensation income which is tax deductable. Ang daily minimum wage kasi natin ngayon is P466.00 kasama na doon yung daily COLA. Meaning kapag more than P466.00 ang ineearn mo daily, then the COLA is taxable.

If you're referring to LAFHA naman then yes, taxable compensation po siya.

isa po akong nurse at nag aapply po ako sa Australia, gusto ko po sanang isama sa experience ko yun 1 year work ko sa isang clinic. ang problema po eh wala po akong tax dun kasi hindi po binabayaran ng employer kasi minimum lang. maliit lang po un clinic at wla din philhealth kasi hindi rin sya accredited nun. ang tanong ko po,
1. pwede po bang ako nalang ang magfile ng tax para may proof ako na nagwork talaga ako dun at nakakareceive ng income(aside from certificate of employment)?
2. patapos na po un 1yr-contract ko dun sa clinic this march, pede pa po ba akong makapagfile ng tax?

You're not required to file an income tax return since you're a minimum wage earner.

pa tanong din ako TS....nag study ako sa isang school at mag wowork sa abroad..yung sa school study now pay later ..... pano ts pag nung nag wowork na ako biglang na layoff at umuwi...at walang work dito sa pinas.. pero required ako nang school na mag bayad monthly sa kanila?...ano lusot ko dun if di ako makabayad agad...before i face a serious lawsuit?.. T.S, Ang Saturday ba is regular day o overtime? nasa maliit na construction company kasi ako ngayon, ang saturday daw is regular day dahil daw sa site kami naassign.. pero sila na nasa office, overtime ang saturday nila..anu ba talaga tama?? hehe..tia

Ang question mo ba about sa mga accounts na dapat mo isettle sa school? Then it's not a labor case. But sige I'll answer your question. It will depend sa usapan niyo ng school syempre (yung mode of payment mo kung monthly ba talaga siya). Simplest way kausapin mo muna yung school nyo na you're willing to settle your balance naman on a given date.. Hindi pa naman lawsuit kaagad agad yan. The most they can give you is a demand letter.. dadaan muna syempre sa conciliation process or alternative settlement bago sila magdecide na magfile ng lawsuit unless talagang ginawa na nila lahat ng way pero di ka padin nagcomply.

Ok, according sa Labor Code, as a general rule 8 hours a day, 6 days a week ang regular na hours of work sa private companies. So overall 48 hours a week siya.

Health personnels lang ang 5 days a week, 40 hours a day. Pero yung general rule na yun pwede naman ma-alter as long as you render 48 hours a week. Note na hindi pa siya overtime. Nagiging overtime lang siya kapag either: 1. beyond 8 hours a day na and 2. beyond 48 hours a week na.

Try to compare muna kung ilang hours a week sila sa inyo, para madetermine mo kung tama ba na OT sila pag Saturday.

hello t.s, kapag b gumawa ng company i.d na walang expiration date at position is valid? may nasusulat ba sa batas kung anu ang dapat mga nakalagay sa i.d?
 
napakatanda na ng batas paggawa ng pilipinas(labor code}ang kaya ang provision sa batas ng labor code ang pwede baguhin ng mga senator ,congressman para makaakma ito sa makabagong paggawa ,sa nlrc or scra report ,marami mga manggagawa natatalo sa kaso dahil lamang technicallity ng kaso .

May nagsabi kasi na kailangan pa daw ako pumasok ng 30 days(?) after ko mag file ng resignation, at yung turn-over ng work. Thanks po sa sagot niyo.
 
Hi, tanong ko lang kung tama lang ba na magrequest ng certain portion of your salary to be tax shield? kasi if you are earning 60k up a month is masyado malaki ang tax kung buong 32% ang ibabawas.

Then pano po ba ang tamang approach to request tax shield?

two weeks ago ng mag sign ako ng contract as probationary employee, for web developer position.
based sa contract na pinirmahan ko bawal ako kumuha ng kahit anong projects even after working hours ko sa company.
pag napatunayan na tumatanggap ako ng project kakasuhan daw ako at mag ffine pa ako ng PHP300,000 sa company.

for probationary employee, meron kaming salary ng PHP350 per day.

then 1 week after signing the contract, meron binigay sa amin na rules and regulations.
ang pinaka ayaw ko lang naman dun si kapag wala kang output within the day you will be marked as absent, so affected ang sweldo ko.
minsan kasi dahil nga sa web programming ang ginagawa namin.. may times na hindi ako nakkatapos ng isang task sa buong maghapon.
which is common naman talaga pagdating sa programming lalo't malaki ang sakop ng ginagawa ko.

so upon calculation ko I will only receive less than PHP7000 a month!
which is bad kasi meron akong binubuhay na pamilya at parang hindi makatarungan yung ganung klase ng sweldo.
may 2 years experience naman ako kaya napag isip isip ko na mag resign na lang.. kahit dipa tapos yung probationary period ko.

ang question ko.. possible pa na makapag file ng case against me si company kung sakali magbigay ako ng immediate resignation?
natatakot kasi ako dun sa fine na PHP300k if ever mag file sila ng case against me.

Im working sa isang company. One of our benefits is to avail a house/lot purchase. Sa Policy max payment 20 year at 6% per anum diminishing term.
yun lang naka lagay sa policy... now I avail 400k for 20 years and was granted.

after start of payment napansin ko beside sa 6 percent may with holding tax na ipinatong sa interest which i computed at 2%.

Tanong:
1. sino ba talaga and mag bayad sa 2% w/h tax every year na ipinatong sa interest?
Kasi ang kinalalabasan 8% lahat ang interest which is way beyond sa stated sa company policy.

ts isa akong line leader sa company,linagay ako ng vp para sa pwesto na yun kc dati madaming problema,pagdating ko dun ramdam ko na ayaw ng manager skin kasi mas gusto nya yung pinalitan ko,,tpus ngyn ako isang staff diba tpus yung isang pinalitan ko regular pilit ng manager na umikot ako sked namin at kmi ang magpalitan,,,ok sana yun kung traning sya sa position na iyon,,kaso hindi e meron ba ako magagawa dun,,maygalit kc skin yung manager e,,salamat po sa magiging advice nyo

Wala naman specific law regarding sa kung ano dapat nakalagay sa ID. They merely serve as an identification that you work for the company. It does not necessarily have to indicate an expiration date as long as what is written is true and correct. Most companies would require na isurrender yung id if youre no longer part of the company. Otherwise subject sya sa fraud w/c is illegal.

That concerns na the company itself. I suggest na tanungin mo muna sa accountant nyo yung breakdown ng taxes then pag may discrepancies you may file for a tax protest before the bir

Legally, and generally speaking resignation must be tendered at least 30 days before its effectivity. This is to provide the employer enough time to look for someone who will takeover the job youll be vacating plus the turnover of the workload. However the 30 day rule is not absolute since it still depends on your employer's consent. In your case, you filed for resignation outright na wala man lang due notice. Clearly, your employer may sue you for breach of employment contract and damages.

I dont think you are allowed to do this as an individual, since tax rates and exemptions are conferred by law. Most companies however practice na ideclare minimum wage as their taxable income then the rest as part of fringe benefits na exclusion from the taxable income.

Multiple TINs are not allowed and is punishable by law since this may serve as a tool for an individual to evade taxes. I am just honestly not sure how, but since it is punishable by law then better comply. In your case i suggest ireport mo nalang sa bir so that they can cancel the former tin. Otherwise if they found out first, you may be liable for tax evasion.

Withholding taxes are mandatory especially in your case na the company acts as a "withholding agent" or a person required to deduct the necessary 6% for your insurance. You pay the 2% based on their authority to deduct a certain amount from your salary and is thus not covered by the insurance policy.

Parang office politics na to, i suggest talk to your next immediate supervisor who can better address your situation with solid basis or evidence of your complaint.
