Hi TS,

actually sa tita ko na problem to eh..

sinangla kasi nila iyong titulo nila,,,sa kakilala ng friend nila..sa halagang 200K ..bale po kalahating ektarya po un ng lupa ...pero wala naman pong kasulatan or anything....basta po nagkasundo sila na ibabalik po iyong titulo pag nakabayad na yong tita ko..
noong nakaraang taon babayaran na dapat ng tita ko iyong 200K na utang niya para makuha na ang titulo..pero ayaw na ibigay noong pinagsanglaan niya..
ano po kaya dapat na aksiyon na gawin namin..

Pinagtraining ako sa ibang bansa for 1 year, kapalit po 5 year contract sa company. Meron po ba tayong law kung ilang years ang katumbas sa 1 year training abroad?
Pagbalik ko po ng pinas nilipat po ako sa ibang department so hindi ko na nagagamit yong training ko sa japan kasi iba na ang nature ng work ko, valid reason na po ba to para mavoid ang bond contract ko na 5 years sa company?
Gusto ko na rin kasing magresign dito.

Dumating na sa time na sobrang hirap na sya sa schedule kasi na eextend sya minsan from 8 hours to 16 hours of work. Kaso ang problema di nila counted as overtime yun at wala rin night differential. Ang ginagawa nila ung sobrang 8 hours yun na daw ung ipapasok niya kinabukasan. Tapos andami pa daw china charge sa kanila pag sablay sa inventory. Ngayon dumating sa point na gusto na mag resign ng asawa ko. Kaya gumawa kami ng resignation letter. Yung reason na nilagay nya is ung time niya para sa pamilya eh wala na. May isa kasi kaming anak. Kaso ang problema ung area coordinator niya ayaw pirmahan ung letter. Binabantaan pa sya na wala siyang makukuhang backpay/graduity na tinrabaho niya ng 9years. Mag papa grand inventory daw yung area coordinator tapos lahat ng variance eh ichacharge sa asawa ko para daw wala makuha. Ano po ba pwede namin gawin. Gusto namin ireklamo sa dept of labor ung area coordinator na un or idemanda.

Hindi labor case to but anyway il answer. Since the real property is worth within 200k then it is considered a small claim case. Generally speaking kahit walang written agreement ang contract as long as there exists consent, object and the price/consideration, the contract is still valid. File your claim before the 1st level court such as the municipal trial court/metropolitan trial court. Hindi kailangan lawyer dito you will only accomplish a statement of claim form, photocopy and original of required documents then docket fees. For more info ask mo clerk sa mtc where you will file your complaint.
 
TS pg ng increase b ang minimum n sahod ng 10php/day kasama rin po ba kahit above minimum na ang iyong salary?

sana masagot tanong ko: bali andito kami ngaun sa province for work pero manila rate kami sa alabang company nmn ! construction company kami 3 months na kami dito pero wala pa kami pinipirmahan na contract or any legal papers to follow n lng daw ! meron kami 175 per day allowance per person !! above minimum kami ang tanong ko po ay ang 175 php allowance po ba ay in kind ibinibigay or cash???... para kasi di umaabot sa 175 per person binibigay nila at tinitipid kami ng company...gusto nmn kunin 175 php per day in cash pwede ba un!!! iginigiit ng company na in kind ang 175 php kumaen man oh hinde pero wala pa 100 per day ung nagagastos!!! pati ask ko na din ung about sa w/ tax ang laki kasi ng kaltas samin ,,sabi ng PIC nmn eh ibabalik din daw ung tax totoo po ba???

Depends kung what kind of fraud, kung saan ginamit. Case to case basis ang treatment ng law sa fraud, but nevertheless, in all cases, shall be proved by clear and convincing evidence.

As a general rule and as in all contracts, a contract is perfected thru its three elements (1) consent (2) object and (3) consideration.

In this case, #1 consent is perfected if both parties (in this case you as the employee and your employer) both agreed to the terms of the contract. The object of the contract on your part is for you to be tied up with the same company for 5 years, in exchange for a 1 year training program abroad, which is then the cause or the consideration of your contract with your employer.

The fact na hindi mo nagagamit yung training mo sa Japan sa nature ng work mo is immaterial. It does not make the contract void. You have no choice but to agree to its terms since you agreed from the very beginning of its terms. Failure to comply with it would be breach of contract where you will be held liable.

If checking account ang ginamit na pambayad pero wala pala talagang balance yung account na yun, then that is considered a criminal offense under a special penal law or BP 22 or the Anti-Bouncing Check Law. Under that law, the act is punishable by imprisonment of 30 days but not more than 1 year or a fine of not less but not more than double the amount of check, which shall not exceed P200,000, or both fine and imprisonment at the discretion of the court. (BP 22). Under the Revised Penal Code naman, it is considered estafa since there is use of deceit in issuance of such check na wala naman talagang laman.

As with regards to estafa, the law imposes the penalty of prision correccional in its maximum period to prision mayor in its minimum period if the amount is over P12,000.00 but does not exceed P22,000.00. If the amount swindled exceeds P22,000.00, the penalty shall be imposed in its maximum period, adding one year for each additional P10,000.00, but the total penalty which may be imposed shall not exceed 20 years.

Civilly speaking, the bank may possess the movable property (car, in this case) for failure to pay the said loan since the car under the chattel mortgage is used as a security for the bank loan. No breach of contract in this case, since the term under a chattel mortgage provides that the car will be used as a security in case of non-payment of the said loan.

Una, understand the nature of your wife's employment contract with SM. Known sila to hire on contract basis lang to circumvent labor standards law para hindi maging entitled ang empleyado sa other benefits like night shift differential, overtime, etc. which are only granted to regular employees. Contractual employee ba siya? Yan kasi practice ng SM, they repeatedly hire employees for 6 months para sweldo lang talaga natatanggap. Marami nang kaso sa SM na ganyan. I suggest consult with the NLRC of your case.

No law provides that above-minimum wage earners will also gain a salary increase equal to the minimum wage increase. The purpose of the law is to help reduce poverty or in this case, bridge the gap between above-minimum wage earners and minimum wage earners. However, the law does not prohibit naman increase in salary to above-minimum wage earners in case there is increase in the daily wage. Ang requirement lang ng law basta walang ssweldo below minimum.

Depende kung ano yung P175 a day na yun. Is it an allowance aside from the salary? Or yun na talaga yung daily wage rate niyo? If it is an allowance aside from the salary, ok lang na in kind siya, depende sa company policy. Pero if it is your actual wage, then it is contrary to the Labor Code. The law provides that wages must be in legal tender--meaning, pera dapat hindi in kind. Another, 175 a day is below minimum. The law provides that if you work for a non-agricultural sector, P481.00 na (as of 2016) dapat ang daily wage rate niyo, while if you work for agricultural sector, P444 ang daily wage rate mo. That is as of 2016.

Also worth mentioning, the fact na wala kayo pinirmahan na employment contract is immaterial. Considered valid ang employment contract the fact that you agreed to work for them and they, in turn agreed to hire you. Ang importante nagccomply dapat sila sa labor laws sa empleyado nila, despite lack of contract terms between you and the employer.

gandang hapon ts ang tanong ko lang eh ano ba ang pwedeng ikaso sa isang tao kapag di nagbabayad ng credit card? natatakot kasi ako sa gf ko kasi dalawang credit card na ang di niya nababayaran kasi naman wala na rin namang sapat na pera para pambayad. Kaso lahat ng contact # nya na nakaregister dun sa credit card bank eh nagbago na kaya parang di na siya matututonton pero natatakot pa din ako sakniya kasi yung address niya eh ganun pa din. Ano ba ang magandang paraan para maayos ito?

Yung tanong ko naman sa akin eh papasok kasi ako ngayon sa bagong work sa bagong companu at nasa 40k monthly ang sasahurin ko pero nung nagcompute na ako ng tax ko eh grabe ang laki. Ano po ba ang pwedeng paraan para mabawasan yung tax ko? single pa din po ako at wala pa ding 60 yrs old ang mga magulang ko at wala pa din akong anak. Maari ba yung idaan via company? TS. may tanong po ako about separation pay. kasi po ang company namin plano nla mg change name ang company then tanong ko po kung mababayan po ba kami ng separation tapoz ano po ba ang computaion ng seration pay?. if hindi kami bayaran ng separation pay may habol po ba kami s employer namin? salamat po s sagot TS. :pray:
 
TS nag resigned nako sa trabaho ko naka 19 years ako, may makukuha ba ako na seperation pay once you resign?

Good day, I had this recent personal issue and had a conflict with my child's mother that started on June 18, 2017. We are not married nor living together. We only had a mutual agreement that I will provide financial sustenance for my daughter. During the course of our argument, on 22 June 2017, she contacted me by phone text and boasted that she had a contact from our company's human resources (according to her it was a personal friend) and was able to gather my personal information and had knowledge about my previous cases with the company. She was able to gather personal information about my colleague's age, full name and personal phone number. Allowing her to contact my colleague on June 22, 2017. The mother of my child is not affiliated with the company I'm current employed. I'm employed full-time.

What legal steps can you advise for me? Thanks.
