Vpn ang Katotohanan

Enlighten me sir, so you may call Kodi and it's add ons as ADVANTAGE for providing easy access to pirated content? or you may call jumper user of electricity taking ADVANTAGE of their wire connected to electricity line without concent?

I think, we are fully aware that what WE are doing is stealing!! We just don't care much because of our Telco's bad service.

It is like, having a prepaid electricity and you have zero load, but you can bypass it using special hardware, would you call it stealing or taking advantage of the LOOPHOLES?

Mind you that china put persons in prison for using VPN!! that is why Shadowsocks is created. I think you get my point, but please let me know otherwise.

Well first of all hindi naman tugma ang analogy mo sa example na ginamit ko. Idk what Kodi is. Yung electric line ba may loophole or parang defect na pwede mo itake advantage wala naman diba yung networks meron. At yung paggamit ng prepaid elec even without load stealing nayun. Di na loophole yun pagnanakaw na talaga yun. Yung special hardware mo dedicated na sa pag bypass ng Kuryente while VPN is not intended for stealing its made for provide privacy connection in Public Places. Coincidentally lang na may loophole yung networks na pwede mo itake advantage or call stealing if you want.
Kaya nila sine-censored yung contents ng internet one way to bypass is VPN kaya pinagbabawal.

Like what i have said, VPN service is Legal, it is the way you use it that is not!

If you use VPN to avoid paying money for internet access, it is a way of stealing. And believe me or not, most symbianizers including me are using VPN to download pirated content. it is the way you use it!! uulitin ko, it is the way you use it!

electricity is the same with internet, they are both infinite but being restricted by monetizing. Parehas silang pay to use kaya ginamit ko sya sa analogy.

using VPN is not stealing, Selling VPN is not a crime in PH

It is the way we use it!

I have to retract my word with Anti fencing law, I have very little knowledge about it, using or selling VPN for free internet may or may not fall under this laws. but we all fall under the terms and conditions of telco's Prepaid SIM terms and conditions!

Salamat.

Assuming you are using a prepaid sim and a device approved by NTC (untampered), then using VPN does not violate RA 8484.

In regard to anti-fencing. "Fencing" is the act of any person who, with intent to gain for himself or for another, shall buy, receive, possess, keep, acquire, conceal, sell or dispose of, or shall buy and sell, or in any other manner deal in any article, item, object or anything of value which he knows, or should be known to him, to have been derived from the proceeds of the crime of robbery or theft.

The question, is the VPN Service Provider committed the crime of theft? The answer is no. The crime is not yet committed. It is the VPN user who will commit the crime, thus the provider and seller will only be liable for accessory to the crime if code exploit/bypass is found in the VPN software.

Theft is committed by any person who, with intent to gain but without violence against or intimidation of persons nor force upon things, shall take personal property of another without the latter’s consent.

Crime of theft is arguable and in my opinion using VPN to access the internet with the intent to gain (by not paying right) is a theft.

Anyway, the more appropriate law to apply is RA 10515. SEC 4 a and c. For prepaid subscriber when you don’t have load or subscription, you no longer authorize to access the internet thus it falls in section 4a without authority. RA 10515 apply as well in wireless such as 3G, LTE, and WiFI because these are delivery system/network.

SEC 4:
(a) intercept or receive, or assist in intercepting or receiving, any signal offered over a cable television system or a cable internet system by tapping, making or causing to be made, any connection to an existing CATV System/Network or Cable Internet System/Network without the authority of the concerned CATV Service Provider or Cable Internet Service Provider;

(c) use or receive any direct or indirect benefit from any CATV System/Network or Cable Internet System/Network with knowledge that it is a result of any of acts enumerated in paragraphs (a) or (b) above: or

Definition of terms:

Cable Internet Service refers to the transmission or delivery of electronic signals for a fee, to provide and facilitate access to the worldwide web, for a fee, through a CATV transmission or delivery system/network.

Cable Internet Service Provider refers to any person natural or juridical, public or private, which was issued a registration certificate as provided under existing laws, rules and regulations, to provide and facilitate access to the worldwide web for a fee, through a CATV transmission or delivery system/network and is actually providing Cable Internet Service to its subscribers

Cable Internet System/Network refers to a facility engaged in the transmission or delivery of electronic signals for a fee, to provide and facilitate access to the worldwide web, for a fee, through a CATV transmission or delivery system/network

ang galing. sakto nga po yung RA 10515. I assumed po may background kau sa Legal world.

and isa pang question, pwede bang gamitin yang vpn pang Grab, uber or angkas?

Are you from TelCos? Because you sound like one hehe.

To answer your question. NO. Kase in the first place, iniipit na nila tayo sa maliit na bandwidth, alam mo ba sa ibang bansa is 10mbs or more is 1300 pesos lang? (convert ko nalang para sayo). Kaya tayong mga pinoy (even indians do this), napaka ma utak natin e, ika nga ng BDO "We Find Ways". That's why sa kakasakal nila sa atin about LOW bandwidth e nag hahanap tayo ng ALTERNATIVE para LUMAKAS ang Internet at BUMABA and babayarin natin. E kung hindi ba business minded and fair lang ang binibigay nila na bandwidth sa subcribers nila, DO YOU EVEN THINK NA HAHANAP KAMI NG PARAAN PARA MAGKA FREENET? NO. A big no.

Ps. Just sharing my own opinion.

Wait wait wait, you mean to say, 10mbps for 1300, ang tanong mobile plan ba yan? Saang bansa, can you link your sources. Mobile plan sana para apples to apples comparison ng speed at price.

Naka ultera ako, pero nagagawa kong unli, that is why i'm interested if hahabulin ba ko ni pldt for having a huge bandwith and speedy connection even thought 5mbps lang plan ko with 50gb.
