Isang magandang araw po sa inyo!

How does AWOL affect your employment?

****Story of random employee*****

Meron kasing isang employee nag tatrabaho sya sa isang malaking kumpanya dito sa Pilipinas. Ngayon pumasok sya as Contractual then after 2 years nagkaroon ng bakanteng posisyon sa team nila. So hiningi ng Immediate Supervisor nya yung resume then send to HR.

After 2 weeks na makalipas, tinawagan na sya for Exam and HR Interview. And then waiting for another week for the result. Lumabas yung result failed sa exam pero pwede naman bypass due to experience nya sa work na vacant positiion.

The problem is yung AWOL nya yung highlight ni HR dun sa Immediate Supervisor and Team Head whether itutuloy pa ba yung processing or not. Kasi hindi nya alam kung anong magiging record once na pinatingin nila sa 3rd Party Agency nila for CI. Pero itong AWOL na ito ay 4 years ago na (2nd work experience/call center). During the interview naman po, naging Honest naman sya kasi dun pa lang sinabi na nya na meron nga syang ganong nagawa.

* Exam - OK (By Pass)
* HR Interview - OK
* Team Head Interview - Hindi na pinatuloy dahil sa highlighted ni HR na problem.

Nag effort na itong employee na kumuha ng clearance dun sa pinag AWOL nya. Binigyan naman sya kaso may record na sya. Kaso ayaw na tanggapin ni Immediate Supervisor (sabi nya ginawa na nya lahat).

Dapat po talagang balikan yung AWOL. Una sa lahat naging Honest sya to tell the truth. Pangalawa nag trabaho sya bilang contractual for 2 years na madami syang na achieve and wala syang bad record. And yung previous job naman sya contractual din with same agency nakapag 2 years din sya.

Gusto ko lang po humingi ng ibang opinyon?

Opinyon ko lang sa AWOL.

Una sa lahat dapat kapag nag AWOL wag muna include yun sa CV or resume mo. Bad record kasi yun.

Pre caution lang yung ginawa ng HR, normal lang yun. lalo na maraming applicant at very competitive ngayon. Isipin mo TS ikaw ung may ari ng company at may nag aaply sayo na may record ng AWOL. magdadalawang isip kang tangapin kasi may record na sya. papasok sa isipan mo na baka gawin nya ulit un kahit na nagkaron na sya ng ibang trabaho for two years.

next time wag nalang include yung work experience na AWOL. Apply nalang ulit at magsimula ng bago. Prayers din TS.

Labor Code requires na 30 day notice dapat ang resignation. However pag nag AWOL ka, here are just some of the effect na pwede mangyari.

First, legally entitled for damages yung employer mo as provided by the law. Anytime they opt to file an action for damages may laban sila against you. Second, you will not be entitled to the financial benefits that comes with resignation. In this case, inexercise lang naman ng management yung right nila to ascertain the facts on your biodata and that is one of the disadvantages too, masisira reputation mo sa future employers once they find out about it.

Pero i'll talk about my personal experience which I regard as an exception. Nag-AWOL ako sa first employer ko when i discovered hindi nila binabayaran economic benefits ko such as SSS, Philhealth and PAG-IBIG. I checked my entire records with these three pero totally walang hulog. I confronted my employer about this pero simula non iniipit na nila ako sa trabaho. Magdedecide sana ako file-an sila ng kaso pero during that time din kasi may better work opportunity sakin. So kumbaga, tabla ang nagyari.. hindi ko na sila kinasuhan, kinalimutan ko totally engagement ko sa kanila; at the same time kinalimutan ko narin yung atraso nila sakin na bayaran yung monthly contributions nila. I think mas mabigat sa part nila kasi pwede silang makulong in case kasuhan ko sila.

When I explained everything sa second employer ko, naintindihan naman ng HR. So ayun. :) I guess case to case basis parin.

Follow-up question lang po:

1. Since itong si Employee pinuntahan nya yung company ng pinag AWOL nya. Then nakausap nya po yung ilang HR personnel. Nabigyan naman sya ng CLEARANCE and ibibigay pa din yung Back Pay nya even AWOL sya and 4 years ago na itong nangyari. What does it mean? Talaga po bang nag issue sila ng clearance even may ganong case sa knila?

Ibig sabihin na settle na yung ISSUE ng AWOL nya kasi nabigyan sya ng clearance at backpay. usually kasi iniisue ang clearance para maibigay ang backpay. pag wala ka clearance wala ka backpay. kung eto ang case pwede sya kumuha ng employment certificate para pwede na nya ilagay sa resume at hindi na AWOL ang status sa employer nya.

IMHO, hindi mo need mag AWOL. FIle resignation may issue or wala 1 month validity nun, pero may mga situation na 15 days kapag valid ang reason or 1 day validity
depende sa reason. at that time pa absent absent ka na hindi na regular pag pasok mo. lahat ng leave mo gamitin mo. EXCEPT marami ka pending na trabaho tatapusin.

reality ang sinasabi ko TS, nag eexist ang situation na ganyan.
